PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS, POLICIES, GUIDELINES, AND DISCLOSURES INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SERVICE.

I. Introduction
These Terms and Conditions govern your access and use of the websites, including wireless services or systems (“websites”) of the Business Owner Ecosystem, Inc. d/b/a Elevate by Principal, and its affiliates (collectively, “Elevate”) (as used here “Principal Financial Group®” or “Principal” refers to the Principal Financial Group, its affiliates, and subsidiaries, jointly and severally). All information accessed or viewed is considered confidential and is for only authorized personal or business purposes.

II. Acceptance of Terms
These websites are the property of one or more of the member companies and/or affiliates of Elevate. By linking, referencing, using, or accessing websites of Elevate, you agree to these Terms and Conditions, including agreeing to indemnify and hold harmless Elevate from all claims of any nature arising from your access and use of these websites. By subscribing to or otherwise using the Service or accessing any content or material that is made available by Elevate through the Service, you agree to be bound by these Terms. For purposes of these Terms and Conditions, “Service” means the services provided by Elevate including access to these websites.

These Terms and Conditions may be changed at any time at the sole discretion of Elevate. These Terms and Conditions pertain to all websites of Elevate including websites owned, operated, or sponsored by any of the subsidiaries or affiliates of Elevate Your continued use of the Service following the posting of such changed or modified Terms will constitute your acceptance of such changes or modifications. Therefore, you should frequently review these Terms and any applicable policies from time to time to understand the terms and conditions that apply to your use.

III. Consent to do Business Electronically

  • By consenting to do business electronically with the Elevate (or member companies), you agree that:

  • You are who you say you are when logging in and transacting business through our websites.
  • If you are logging in on behalf of your employer, you have the appropriate authority to log in and conduct business electronically on its behalf.
  • This Consent applies to any transactions conducted through our website.

  • You will need access to a computer with a current internet browser and an operating system that allows you to save files or print web pages and documents. See hardware and software recommendations below for more information.
  • You may print this Consent and any electronic record or you can contact us to request a paper copy to be mailed to you free of charge.

  • United States laws and Iowa laws govern our sites and your use of them.

IV. SMS Alerts
Please note that this section does not apply to text messages sent for account security or multi-factor authentication purposes. If you have opted in to receive account-related, marketing, or other alerts from Principal via text message (“Text Alerts”), we will send you a message to confirm your signup. Text ACCOUNT to 734734 to receive Principal Account Services Alerts. Message and data rates may apply. Message frequency will vary based on your use. Text HELP for help. Text STOP to cancel.

You can cancel Text Alerts at any time by texting STOP to 734734. After you send the message STOP to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive account-related, marketing, or other alert messages from us.

V. Secure Websites
By using, accessing, or attempting to access websites of Elevate that require you to log in (these are defined as "secure websites"), you are certifying you are the person legally associated with the username, password, login image and phrase or additional method(s) of authentication being used.

Unauthorized access or use or attempts to access or use secure websites of Elevate is prohibited and may violate federal and/or state law. Elevate may report unauthorized access, use, or attempts to access or use to law enforcement.

VI. Intellectual Property; Link and Logo Licensing
The content found on websites of Elevate, including without limitation, the text, graphics, videos, selection and arrangement of information, and page layouts, is protected by copyright and other intellectual property laws and treaties. You may download and print copyrighted materials for your personal non-commercial use only. You may not modify, transmit, or distribute any of the copyrighted materials without the specific written consent of Elevate.

Trademarks, service marks and logos used on websites of Elevate are registered and unregistered trademarks, protected by the laws of the United States and other countries worldwide. Trademarks, service marks and logos used on these websites that have been provided by others are the property of their respective owners. You may not use any of the trademarks, service marks or logos found on these websites without the specific written consent of Elevate or their respective owners.

VII. Privacy
All personal information that Elevate collects regarding you and your business is subject to Principal’s Global Privacy Statement and these Terms and Conditions.

Elevate may disclose information regarding you or your business with our Strategic Partners in connection with providing the Service. You hereby consent to, and are directing Elevate to engage in, such disclosure of information to our Strategic Partners. Strategic Partners Information that you choose to share with Strategic Partners outside the Service will be subject to that Strategic Partner’s separate privacy policies and/or terms and conditions. Elevate also may engage with Strategic Partners as part of its Ecosystem. As part of this engagement, Elevate may have a relationship with the Strategic Partner that compensates said Partner for bringing Business Owners into the Ecosystem. Strategic Partners also may be customers of Principal Financial Group, Inc. and its affiliates. Elevate may collect additional information regarding your business from our third-party service providers. For more information regarding Elevate and Principal’s privacy practices, please see Principal’s Privacy Page. For more information regarding data security, please see Principal’s Security Policies. For purposes of these Terms and Conditions, a Strategic Partner is defined as a third party that has contracted and, in some cases, provided compensation separately to Elevate to be displayed as a entity or party on the Ecosystem with whom you may engage with and/or interact with.

VIII. No Legal or Investment Advice; Calculators/Calculations
While communication may be used to promote or market a transaction or an idea that is discussed in the websites of Elevate, it is intended to provide general information about the subject matter covered and is provided with the understanding that Elevate is not rendering legal, accounting, or tax advice. It is not a marketed opinion and may not be used to avoid penalties under the Internal Revenue Code. You should consult with appropriate counsel or other advisors on all matters pertaining to legal, tax, or accounting obligations and requirements.

This website also contains video and audio files where the comments were valid on the date the files were recorded. Markets move continuously and you should only rely on current information for any investment decisions.

Retirement and/or financial calculators/calculations which may be provided within these websites are provided solely for you to estimate hypothetical future financial or retirement status. Elevate may provide, or third parties may provide, for your convenience and information only, links to other websites. Because Elevate does not have control over these sites, you agree that Elevate is not responsible for any liability resulting from the access or use of sites not owned by Elevate and that Elevate is not responsible for any content, advertising, product, or any other matter or issue, available online, whether linked to, or from, websites of Elevate Further, you agree that Elevate shall not be responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused by or in connection with the use of websites Principal does not own.

XI. Third Party Applications - Modification Prohibited
Elevate may provide you with access to third-party applications and services through its websites. You agree not to modify, decompile or reverse engineer any such third-party applications, or any code related to such third-party applications.

XII. Termination and Blocking
When you register for an account, you must (a) provide accurate and complete information, and (b) update such information from time to time as necessary to keep your registration information current and accurate. By establishing an account, you represent and warrant that you have the right to, and are authorized to, provide the information you provide when you register for the account. You are responsible for maintaining the confidentiality of your account information and password and for restricting access to such information and to your computer. All activities that occur under your account or password will be your responsibility.

In using the Service, you agree not to engage in any of the following activities: (a) any resale or commercial (non-personal) use of the Service or the Materials therein; (b) the distribution, public performance or public display of any of the Materials; (c) any modification or derivative use of the Service or the Materials, or any portion thereof; (d) any use of automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service; (e) the download (other than page caching) of any portion of the Service, the Materials, or any information contained therein, except as expressly permitted; (f) any attempt to gain unauthorized access to Business Owner Ecosystem, Inc’s servers or computer systems or to engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, any part of the Service; (g) the collection or harvesting of any personally identifiable information, including, but not limited to, company names, domain names or account names, from the Service, or the use of communication systems provided by the Service for any commercial solicitation purposes; (h) the use of any portion of the Service as a destination linked from any unsolicited bulk messages or unsolicited commercial messages; or (i) any use of the Service or the Materials other than for their intended purpose.

You agree that you will not, and will not assist or enable others to use the website: (a) to threaten, stalk, defraud, incite, harass, or advocate the harassment of another person or entity, or otherwise interfere with use of the website; (b) in violation of these Terms or any applicable law; (c) to modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, link to, or in any way exploit the website or website content except as expressly authorized by Elevate; (d) to mine, record or gather information about other users.

Elevate may terminate or suspend your account and/or ability to use the website, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability of any kind.

XIII. Monitoring
Elevate reserves the right to monitor your access and use of its websites without notification to you. Elevate may record or log your use in a manner as set out in privacy policies.

XIV. Hardware and Software Recommendations
You can access our websites using a current internet browser. If you're on an older browser and are having issues with our site, we suggest you install a more current browser.

In addition to using a current browser, you must also be sure certain browser settings are enabled to access our websites. Cookies must be enabled to access secured areas of the site (such as viewing account information), Javascript must be enabled and stylesheets must be enabled. Note: by default, all of the above items are enabled when you install a browser.

Additional software is needed to view some features on our site, which may include Adobe® Reader, RealPlayer®, Microsoft® Windows Media® Player, etc.

Software installed to prohibit pop-ups or restricted banner ads might interfere with this site and cause you to experience general errors or frozen pages. We recommend that this software be disabled or un-installed before using this site.

XV. Export Control
The United States controls the export of products and information. You agree to comply with such restrictions and not to export or re-export any Material to countries or persons prohibited under the export control laws. By downloading any Material, you are agreeing that you are not in a country where such export is prohibited and that you are not a person or entity to which such export is prohibited. You are responsible for compliance with the laws of your local jurisdiction regarding the import, export, or re-export of any Material.

XVI. Limitation of Liability
You agree that your access to, and use of, the websites of Elevate and the content thereof is at your risk. You agree that under no circumstances shall Elevate be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages arising from viruses, worms, trojan horses or other code that has contaminating or destructive properties or our reference, using, accessing, inability to use or access or linking to or from the websites of Elevate or any errors or omissions in the content thereof. There are some jurisdictions that do not allow for the exclusion of certain warranties or the limitation or exclusion of liability for consequential or incidental damages. Based on this conclusion, the liability of Elevate is limited to the greatest extent permitted by law.

XVII. Governing Law; Severability
These Terms of Use are governed by the laws of the State of Iowa with jurisdiction and venue being in Polk County, Iowa. You agree that your referencing, using or accessing websites of Elevate constitutes your acceptance of the jurisdiction of state or federal courts in Polk County, Iowa and that legal action may be brought against, or by, you must be brought in state or federal courts in Polk County, Iowa.

In the event any of the provisions of these Terms and Conditions shall be determined by a court of competent jurisdiction to be invalid, any such provision determined to be invalid shall not effect the validity of all remaining provisions.

XVIII. Social Media, Blog Commenting, Photographic, and Video Content
We welcome comments, opinions, and questions. You may have the opportunity to upload photographs and video content at part of this Service. Anything threatening, libelous, defamatory, obscene, pornographic, or other material that would violate the law will be deleted. Any Content including comments, opinions, questions, photographs including business logos, videos or other media uploaded or added to the website is property of the Ecosystem and by uploading such Content, you consent to use by the Ecosystem without limitation.

We take our customers' security very seriously. We do not respond to any questions that pertain to a specific individual, account, or financial issue.

We do not endorse any of the third-party content posted on our social media properties, nor do we have any control over it. No part of our social media properties is intended to act as a recommendation, suggestion, or testimonial for any service or product.

XIX. Right of Refusal
Elevate reserves the right to refuse to provide Services as defined herein to any customer and/or potential customer and shall not be required to be provide a basis for such a decision to the customer.

XX. Relationship
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Elevate.

XXI. Charges and Billing
Elevate charges a fee for Service. You must provide a valid credit card number when you subscribe to the Service. You represent and warrant that you are authorized to use such credit card, and you agree to pay all charges incurred using your account. You agree that we may pass your credit card information and related personally identifiable information to our designated service provider(s) for their use in charging you for the Service ordered by you. All charges are exclusive of sales and other taxes, and you are responsible for payment of any applicable taxes (other than taxes on Elevate income). We reserve the right to accept or reject orders for any reason. Price and availability of Service are subject to change without notice (unless you have purchased an ongoing subscription to a Elevate Service, in which case the subscription price paid by you for such service shall apply during the term of such subscription). You agree that any payment submitted by you for Elevate Service is submitted on behalf of yourself, without expectation of any reimbursement by third-party payers.

Elevate may offer paid service plans which provide for ongoing Products over a specified period (for example, quarterly or annually). Any such plan shall automatically renew at the end of the stated service period (and again at the end of any subsequent renewal period) at the then-current renewal price until cancelled. The fees charged for subsequent renewal period are nonrefundable. Please note that Elevate may provide refund(s) for current service plans or enrollments at its sole discretion regardless of when you cancel your account before the current service period expires. In addition, you may be responsible for paying any balance due on the account when you cancel. You agree that we may charge any unpaid fees to you through the payment method you provided during registration, and/or we may send you a bill for such unpaid fees.

XXII. Entire Agreement
These Terms and Conditions constitute the complete and exclusive statement of the Agreement between the parties with respect to the use of the Service and supersedes all prior or contemporaneous communications, representations, statements and understandings, whether oral or written, between the parties with respect to the subject matter thereof.

You agree to abide by our Terms and Conditions and not to use the Service or any part thereof in any manner not expressly permitted by these Terms. Except for the rights expressly granted to you in these Terms and Conditions, Elevate grants no right, title, or interest to you in the Service. Any Elevate software applications of the Service are licensed, not sold, to you, and Elevate and its licensors retain ownership of all copies of the Elevate software applications even after the potential installation, use, or download on your personal computers, mobile handsets, tablets, and/or other relevant devices.
